Terms of Service

§1. General Provisions

1. These Terms of Service govern the use of the website available at www.yourrent.com and the process of booking vehicle rental services offered by YourRent.

2. Using the Service constitutes acceptance of these Terms of Service.

3. The Terms of Service are made available free of charge through the Service in a manner allowing them to be downloaded, saved, and printed.

§2. Service Provider Details

hereinafter referred to as "YourRent" or "Service Provider".

§3. Nature of Information Presented on the Service

1. Information, prices, vehicle descriptions, photos, equipment, rental periods, and additional services presented on the Service are for informational purposes only and do not constitute an offer within the meaning of the Civil Code.

2. Vehicle photos presented are for illustrative purposes only.

3. The Lessor does not guarantee the availability of a specific vehicle model, but only a vehicle from a given group or class, unless explicitly stated otherwise.

4. The final terms of rental are set out in the Rental Agreement and the General Terms and Conditions of Rental (GTC).

§4. Service Reservations

1. The User may make a vehicle reservation through the Service.

2. Making a reservation requires:

• selecting the pick-up and drop-off location,
• specifying the rental date and time,
• selecting a vehicle or vehicle group,
• providing required contact details,
• accepting the Terms of Service and Privacy Policy.
  

2. Depending on the type of reservation, YourRent may require additional information necessary for the preparation of the Rental Agreement.

3. Reservation confirmation is sent to the e-mail address provided by the Customer. Making a reservation does not release the Customer from the obligation to meet the rental conditions set out in the GTC.

4. Use of the Platform is voluntary.

5. The Customer is obliged to use the Platform in accordance with the law and good practices.

6. Providing unlawful content is prohibited.

7. The Platform allows browsing the offer, making reservations, purchasing additional services, and making online payments.

§4. Technical Requirements

1. To use the Platform, the following are required:

• a device with Internet access,
• an up-to-date web browser,
• an active e-mail address

2. YourRent is not liable for limitations resulting from failure to meet technical requirements.

§5. Payments

1. Reservations may be paid online using the payment methods available on the Service.

2. The payment operator is the entity indicated during the reservation process.

3. YourRent does not store full payment card details of Customers.

4. Detailed payment terms are specified during the reservation process.

§6. Security Deposit

1. In connection with the execution of the Rental Agreement, YourRent may collect a refundable deposit from the Customer.

2. The deposit amount depends on the vehicle category, rental conditions, driver's age, vehicle pick-up location, and the selected protection package.

3. The deposit may range from 1 PLN to 10,000 PLN.

4. The detailed rules for collecting, settling, and refunding the deposit are set out in the General Terms and Conditions of Rental.

§7. Withdrawal from the Agreement and Reservation Cancellation

1. The services offered by YourRent relate to vehicle rental provided at a specified date or period.

2. Pursuant to Art. 38 sec. 1 point 12 of the Act of 30 May 2014 on consumer rights, the Consumer is not entitled to the statutory right of withdrawal from a distance contract within 14 days without giving a reason.

3. Notwithstanding the provisions of sec. 2, the Customer may cancel the reservation in accordance with the rules set out in the General Terms and Conditions of Rental.

4. In the event of cancellation of a reservation at least 24 hours before the planned vehicle pick-up date, the Customer is entitled to a refund in accordance with the rules set out in the GTC.

§8. Complaints

1. The User has the right to submit complaints regarding:

• the functioning of the Service,
• the reservation process,
• services provided electronically by YourRent.

2. Complaints may be submitted:

• electronically to the address: reklamacje@yourrent.com,
• in writing to the Service Provider's registered address.

3. A complaint should include:

• data identifying the User,
• contact details,
• a description of the reported objections.

4. YourRent will consider the complaint within 14 days of receipt.

5. The response to the complaint will be provided electronically or in writing.

§9. Personal Data Protection

1. The controller of personal data is YOUR RENT Sp. z o.o. with its registered office in Chorzów.

2. Personal data is processed in accordance with applicable law and the Privacy Policy available on the Service.

3. The detailed rules for processing personal data are set out in the Privacy Policy.

§10. Intellectual Property

1. All rights to the Service, its graphic elements, texts, photos, trademarks, logos, and materials belong to YourRent or its partners.

2. Copying, distributing, or using materials posted on the Service without the prior consent of YourRent is prohibited.

§11. Final Provisions

1. Polish law applies to the use of the Service.

2. In the event of disputes with a Consumer, the jurisdiction of the court is determined by applicable law.

3. The Consumer may use out-of-court dispute resolution methods, in particular with the help of the competent consumer ombudsman or other authorized entities.

4. YourRent reserves the right to amend the Terms of Service in the event of:

• changes in law,
• technological changes,
• changes to the Service's functionality.
